3、Qualification Requirements For Bidder
Qualifications or Performance:1) In the case of a Bidder offering to supply goods which the Bidder does not manufacture or otherwise produce, the Bidder has been duly authorized by the goods' Manufacturer or Producer (In the case of Letter of Authority issued by the Producer, the Letter of Authority provided by the original manufacturer to the producer shall be provided at the same time) to supply the goods in this bidding project, format as per Section 4 Form IV-9-4, the "Letter of Authority from Manufacturer" shall be original. The detailed requirement shall be specified in the technical part of the Bidding Document. Meanwhile, The original statement of manufacturer qualification from the original manufacturer or its authorized distributor of the goods shall also be provided.
5) Add: The bidder shall meet the following qualification conditions:
The bidder (including its owner) shall be a legal entity, self-employed, independent accounting, and meet the qualification conditions described below:
a)The annual average turnover of the bidder or his owner is at least 25 million US dollars in the last three years (from 2018 to 2020). The bidder shall provide a set of copies of audited financial statements in the last three years (from 2018 to 2020), meanwhile, a Chinese and/or English translation shall be provided for reference. For bid evaluation, if the currency in the financial statements is not U.S. dollars, it will be calculated as U.S. dollars at the spot selling price between foreign currency and RMB initially published by the Bank of China, head office on the bid opening day.
b) The bidder shall provide the original Letter of Credit only for this project which is issued by the bidder's bank (a reputable bank with branch-level or above within or outside the People's Republic of China) before the bid opening date, together with a Chinese and/or English translation for reference. The Letter of Credit should clearly indicate that the line of credit for this project shall not be less than 12 million US dollars. If the project name and bid number are not indicated in the Letter of Credit or if the Letter of Credit is issued by two or above banks, the bid will be rejected.
c) The bidder should have completed (the signing date of the project contract is prevail) at least 2 similar projects after January 1, 2016 (Similar projects refer to equipment supply projects utilizing Israeli government loans and completed in China with each contract price of no less than 10 million US dollars). The bidder shall provide relevant written support documents, including but no limited to the color-scanned copies of key pages of contracts. These relevant documents shall at least be able to prove that the bidder meets the project requirements. The copy of the key pages of contract shall at least show site, content, the contract price, signing date, and signatures of all parties, meanwhile a Chinese and/or English translation shall be provided for reference. For bid evaluation, if the currency in the financial statements is not U.S. dollars, it will be calculated as U.S. dollars at the spot selling price between foreign currency and RMB initially published by the Bank of China, head office on the bid opening day.
d) The bidder shall not be in a state of being ordered to close down, disqualified from bidding, the property being taken over or frozen and bankrupt. The bidder should provide a letter of commitment sealed and signed by the legal representative to prove.
e) The bidder shall not cheat for winning a bid, significant violations of contract and serious quality problems. The bidder should provide a letter of commitment sealed and signed by the legal representative as evidence.
f) The bidder shall be legally and financially autonomous, and under no supervision by the tenderee or the tendering agent. Bidders having the same person in charge or having controlling shareholders and management in common are not allowed to participate in this project at the same time. A letter of commitment issued by the applicant and sealed and signed by the legal representative shall be provided to prove the conditions mentioned above.
g) The bidder or his owner shall not have any adverse records of being claimed by domestic Employers or tendering agents requesting the domestic competent authority for compensation in written in the foreign government loan project. A letter of commitment clarifying the conditions mentioned above must be provided together with the bid. The bid will be rejected if the letter of commitment is not provided or a false letter is provided.
(h) The bidder or his owner shall be profitable in the last three years (from 2018 to 2020), and the net asset should be positive each year (from 2018 to 2020). That is, the difference between total assets and total liabilities should be positive. The bidder shall provide a set of copies of audited financial statements in the last three years (from 2018 to 2020), meanwhile, a Chinese and/or English translation shall be provided for reference.
(i) The bidder shall be private, public, or state-owned legal entities registered in Israel and shall be in normal operation for more than 5 years. The registered capital of the bidder or his owner shall not be less than 5 million US dollars. The bidder shall provide a set of copies of the registered scope of business, business license, and/or all relevant registration documents as well as a Chinese/English translation for reference in the bid.
(j) The bidder shall provide accurate litigation or arbitration information and the maximum liability limit during the completion or execution of the contract since January 1, 2018. If there is any pending litigation and arbitration, it shall be judged as unfavorable to the bidder, and the total amount shall not exceed 50% of the net value of the difference between the bidder's total assets and total liabilities. If the information shows that the bidder always loses, his bid will be rejected.
(k) The bidder or his owner shall not fail to deliver any goods/equipment under the contracts financed by foreign government loans for their own reasons for more than 12 months since the date of receiving the advance payment. A letter of commitment clarifying the conditions mentioned above must be provided together with the bid. The bid will be rejected if the letter of commitment is not provided or a false letter is provided.
(l) Joint Venture is not permitted.
